ICE’s New Policy For Vulnerable Immigrants
Last week, ICE (U.S. Immigration and Customs Enforcement) announced that a new policy will be put in place that is designed to protect vulnerable immigrants. These protections are for survivors of violence, trafficking, and domestic abuse.
In this policy it constrains ICE, in most circumstances, from taking actions against Individuals with pending applications for victim-based protections:
- Issuing detainers
- Issuing a Notice to Appear, the charging document in immigration court proceedings.
- Stopping, questions, or arresting an individual.
- Executing a removal order, i.e., deportation from the United States
It will also constrain ICE from taking enforcement actions during a pending criminal investigation or prosecution, unless authorized by headquarters officials.
